Terms of Service

1. Acceptance

By purchasing or using MediSim OSCE Simulator (the "App") or browsing this website (the "Site"), you agree to these Terms of Service. If you don't agree, don't use the Site or the App.

2. What you're buying

MediSim OSCE Simulator is sold as a one-time purchase, lifetime license (one-time purchase · lifetime license) covering the current major version and free updates to that version, sold through Gumroad or Steam — whichever checkout provider you choose at purchase. It's a desktop application for practicing OSCE (Objective Structured Clinical Examination) history-taking against an offline, AI-driven simulated patient.

3. License grant

Subject to payment, we grant you a personal, non-exclusive, non-transferable license to install and use the App on devices you own or control, for your own study and training purposes. You may not resell, sublicense, rent, or redistribute the App or its models and assets, or use it to build a competing product.

4. Payment & refunds

Payments are processed by whichever provider you choose at checkout — Gumroad or Steam. Pricing, currency, and receipts are handled entirely by that provider's checkout. Refunds are subject to that provider's standard policies — for Steam purchases, this means Steam's Refund Policy — unless local consumer law grants you additional rights.

If you are a consumer in the EU, UK, or EEA, digital content purchases are typically not subject to the standard 14-day withdrawal right once you've started using the App and explicitly acknowledged this at checkout — however, if the App is materially defective, your statutory consumer rights are unaffected.

5. Not a substitute for clinical training or medical advice

The App is a study and drilling tool. It does not replace supervised clinical placements, real patient contact, or examiner feedback, and nothing generated by the simulated patient or the AI evaluation constitutes medical advice or a guarantee of exam performance or outcome.

6. AI-generated content

Patient dialogue, emotional responses, vitals, and feedback scores are generated by a local AI model and may occasionally be inaccurate, inconsistent, or clinically imperfect. Use your own judgment and consult qualified faculty or instructors for authoritative guidance.

7. Availability & updates

We aim to keep the App working and to ship updates via our checkout providers, but we don't guarantee uninterrupted availability, specific hardware compatibility, or that any particular feature will be maintained indefinitely.

8. Intellectual property

The App, its branding, scenario content, and associated assets are owned by us (or licensed to us) and protected by copyright. Nothing in these Terms transfers ownership to you beyond the license in Section 3.

9. Disclaimer & limitation of liability

The App and Site are provided "as is," without warranties of any kind, to the maximum extent permitted by law. To the extent permitted by applicable law, we are not liable for indirect, incidental, or consequential damages arising from use of the App or Site. Nothing in these Terms limits liability that cannot be excluded under applicable consumer protection law.

10. Termination

We may terminate your license if you materially breach these Terms (for example, redistribution or piracy). You may stop using the App at any time.

11. Governing law

These Terms are interpreted in good faith. Nothing in these Terms limits any mandatory consumer-protection rights you have under the law of your country of residence.

12. Changes to these terms

We may update these Terms from time to time; continued use of the App after an update constitutes acceptance of the revised Terms.
